Welcome to Barelab. These Terms and Conditions ("Terms") govern your use of the Barelab mobile application and related services (the "Service") operated by Barelab ("we," "us," or "our"). By downloading, installing, or using our Service, you agree to be bound by these Terms. References to "we," "us," or "our" include Barelab, its developers, officers, employees, contractors, and agents.

If you do not agree to these Terms, you must immediately discontinue use of the Service. Continued use constitutes acceptance of the most recent version.

This document is an electronic record under the Information Technology Act, 2000 and the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021.

Barelab is an AI-powered skin wellness application that provides:

• Personalized skincare analysis and recommendations
• Skin health tracking and monitoring
• Product recommendations based on AI analysis
• Educational content about skincare and wellness
• Progress tracking through photo analysis

Important Notice

Our Service is designed to complement, not replace, professional medical advice and treatment.

We are NOT a medical service provider, dermatologist, or pharmacy. All information and recommendations provided by our Service are for informational purposes only. You should consult a qualified healthcare professional before acting on any recommendation.

To use certain features of our Service, you must create an account. You agree to:

• ✓ Provide accurate, current, and complete information during registration
• ✓ Maintain and promptly update your account information
• ✓ Keep your login credentials secure and confidential
• ✓ Be responsible for all activities under your account
• ✓ Notify us immediately of any unauthorized use of your account

Age Requirement

You must be at least 18 years old to use our Service.

We will verify your age and/or identity via OTP, email or other methods. If we discover you are under 18, we will terminate your account and delete associated data.

You agree to use our Service only for lawful purposes and in accordance with these Terms.

You agree NOT to:

• ✗ Use the Service for any illegal or unauthorized purpose
• ✗ Upload false, misleading, or inappropriate content
• ✗ Attempt to gain unauthorized access to our systems or other users' accounts
• ✗ Interfere with or disrupt the Service or servers
• ✗ Use automated scripts, bots, or similar technologies without permission
• ✗ Reverse engineer, decompile, or disassemble any part of the Service
• ✗ Share your account credentials with others

Prohibited Content

You also agree not to upload content that includes:

• Nudity or sexually explicit material of any kind
• Obscene, pornographic, or sexually suggestive imagery
• Images of children (anyone under 18 years of age)
• Content depicting or promoting child abuse or exploitation in any form
• Content that is defamatory, harassing, or threatening
• Content that invades privacy or violates confidentiality
• Content depicting illegal activities or promoting violence
• Content that violates national security or religious harmony
• Content that promotes self-harm or harm to others
• Malicious code, viruses, or harmful software
• Any other content prohibited by applicable law

Violation may result in immediate suspension or termination of your account without refund.

Barelab is not a medical service and does not provide medical advice, diagnosis, or treatment. Our Service is for informational and educational purposes only.

You Must:

• ✓ Always consult with qualified healthcare professionals for medical concerns
  • Do not rely solely on our AI analysis for medical decisions
  • Our AI cannot diagnose medical conditions or diseases
• ✓ Seek immediate medical attention for serious skin conditions
  • Including but not limited to: severe rashes, suspicious moles, infections, sudden changes, painful lesions
• ✓ Discontinue use of any recommended products if you experience adverse reactions
  • Stop using products immediately if you experience irritation, allergic reactions, or worsening symptoms
  • Consult a healthcare professional if reactions persist

Our Limitations:

• Our recommendations are general guidance and may not be suitable for everyone
• Results vary based on individual skin types, conditions, and circumstances
• We make no warranties regarding the accuracy or suitability of analysis results
• AI analysis may contain errors or inaccuracies

Your Responsibility:

Use of the Service is at your own risk. You are solely responsible for:

• Decisions made based on our analysis or recommendations
• Selection and use of any products or treatments
• Monitoring your skin health and seeking professional care when needed

The Service and its original content, features, and functionality are owned by Barelab and its creators, and are protected by intellectual property laws.

Your License to Use

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

Your Content

You retain ownership of the content you upload to the Service, but grant us a license to use, process, and analyze such content to provide our Service. Specifically, you grant us a worldwide, royalty-free, sublicensable license to host, reproduce, modify, adapt, publish, translate, distribute and display such Content for the purpose of providing and improving the Service.

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you consent to the collection and use of your information as described in our Privacy Policy.

Data We Collect

We collect and process data including facial and skin images in order to provide the Service. Data may be:

• Stored in India or abroad
• Anonymized for analytics and service improvement
• Processed by third-party service providers

Your Rights

You have the right to access, correct, and delete your personal data by contacting us as per the Privacy Policy.

Some features of our Service may require payment. If you purchase a subscription:

• You agree to pay all applicable fees as described in the Service
• Subscriptions automatically renew unless cancelled
• You may cancel your subscription at any time through your account settings
• Refunds are subject to our refund policy and applicable law
• We reserve the right to change subscription fees with reasonable notice

Payment Processing

All payments are processed securely via our third-party payment processor. We do not store your full payment card details on our servers.

Refund Policy

All sales are final once payment is processed, except where refunds are required by law or at our discretion. Automatic renewals will be charged unless cancelled at least 24 hours before renewal.

To the fullest extent permitted by law, Barelab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms limits liability for gross negligence, willful misconduct or for death or personal injury caused by our negligence.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

We reserve the right to terminate or suspend your account and access to the Service at any time, with or without notice, for any reason, including violation of these Terms.

You may terminate your account at any time by contacting us. Upon termination:

• Your right to use the Service will cease immediately
• We may delete your account and data
• If your account is terminated for violation of these Terms, you will not be eligible for any refund of subscription fees

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India.

The parties shall first attempt mediation or arbitration under the Arbitration and Conciliation Act, 1996 before commencing court proceedings.

YOU AND BARELAB AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Unless both you and Barelab agree otherwise, the arbitrator or court may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

If this specific provision is found to be unenforceable, then the entirety of this arbitration and class action waiver provision shall be null and void.

Barelab shall not be liable for any failure or delay in performance of its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to:

• Acts of God, natural disasters, pandemics, or epidemics
• War, terrorism, civil unrest, or government action
• Internet or telecommunications failures not caused by Barelab
• Power outages, server failures, or third-party service disruptions
• Labor disputes or strikes
• Any other events beyond our reasonable control

During such events, our performance obligations will be suspended for the duration of the force majeure event.

Upon receiving actual knowledge (through a court order, government notice, or user complaint) that any content hosted violates applicable law or these Terms, Barelab will act expeditiously to remove or disable access to such content.

Barelab may also voluntarily remove content that violates its policies or the Intermediary Guidelines Rules, 2021.

Barelab observes due diligence under Section 79 of the Information Technology Act, 2000 and the Rules made thereunder. This includes:

• Maintaining reasonable security practices
• Publishing policies and terms
• Appointing a Grievance Officer
• Cooperating with lawful requests from government authorities

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the app or by email.

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms. We will give you at least 30 days' notice of major changes and highlight what changes are being made.

If any provision of these Terms is found to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
